Terms of use for PIKO Solar Portal

1. General information

The PIKO Solar Portal is a free site provided by KOSTAL Solar Electric GmbH, Hanferstr. 6, 79108 Freiburg i. Br. The user is currently only liable for costs that arise due to the disclosure of data for the PIKO Solar Portal or due to the accessing of data from the PIKO Solar Portal. In the event of further development of the site, KOSTAL reserves the right to withdraw free use.

All information and results available on the PIKO Solar Portal site must be checked by the respective user for its coherence and the conclusions to be drawn from it. The data/information constitute a purely informative and visual aid and do not permit the drawing of conclusions of any kind in view of warranty/warranty claims.

The user has no claims for the permanent availability of all data or information. KOSTAL Solar Electric GmbH reserves the right to edit the site or subsections without prior notice or remove its display from the website in part or in full.

2. Agreement to the terms of use

By actively using the PIKO Solar Portal (login), the user agrees to the terms of use listed here.

3. Terms of use

In order to guarantee the use of the site "PIKO Solar Portal", the respective user must register in the PIKO Solar Portal with his personal data (e-mail, name, user name and system data) and permanently connect the inverter to the PIKO Solar Portal. In cases of false declarations, KOSTAL reserves the right to terminate or deny access to the respective system data.

The company KOSTAL Solar Electric GmbH along with associated companies (hereinafter referred to as "KOSTAL") is entitled to evaluate all system and inverter data statistically. In cases of deregistration or termination of the system/user, KOSTAL reserves the right to use the anonymous data for purposes of statistical evaluation. The respective system and inverter data may also be used for purposes of more rapid processing in service cases and for event analysis.

In cases of manipulation of data transfer, the PIKO Solar Portal or unauthorised access to all sites provided by KOSTAL, it reserves the right to exclude the respective user and take legal action. KOSTAL also reserves the right to ban users from accessing the PIKO Solar Portal and to remove these users after notifying them.

Access to the personal systems of a user requires the respective approval of the system owner. In the event of a user being revoked in response to unauthorised access, KOSTAL reserves the right to remove access by a potentially unauthorised user.

4. Use restrictions

The data from the PIKO Solar Portal are only approved for the company's own evaluation purposes. All data displayed there consist of mean values which have been processed by the portal and are not suitable for billing purposes towards third parties.

5. Copyright notice

Content and representation of KOSTAL websites are protected worldwide. Copying, issuing to other parties or any kind of use, in whole or in part, is prohibited without prior permission. Photographs used by us may not be used without express permission. All rights - including protective right applications - are reserved.

Material on the site produced by KOSTAL and the user is protected by German copyright. This website may not be reproduced, edited, disseminated or used in any way that exceeds copyright without the written consent of the respective author. Downloads and copies of this website may only be used privately and not for commercial purposes (except following consultation and written consent). Where use is made of content which was not produced by the site operator, the copyright of third parties is respected. Content produced by third-parties is identified as such. However, should you notice any copyright infringement, please notify us. If we become aware of any such infringement, we will remove the necessary content immediately.

6. Exclusion of liability

KOSTAL Solar Electric GmbH assumes no liability and provides no guarantee for the validity, accuracy, completeness or quality of the provided evaluations, information or automatically generated documents or notifications. No liability of any kind is assumed for any errors or omissions in the specified data and sources referenced there.

KOSTAL assumes no liability for the content, any damage or legal violations of web addresses linked on its own website. The use of these links takes place at the risk of the user. The user him/herself is responsible for the protection of his/her computer against viruses, Trojans, spam, etc. Furthermore, the user is required to not perform any deliberate harmful or illegal acts when using the portal.

KOSTAL SOLAR ELECTRIC GMBH EXCLUDES ANY LIABILITY FOR THE USER AND OTHER PERSONS OR COMPANIES (THIRD PARTIES). HOWEVER, SHOULD AN EXCLUSION OF LIABILITY BE UNFEASIBLE FOR LEGAL REASONS, THE FAULT-BASED LIABILITY OF KOSTAL SHALL BE LIMITED TO INTENT OR GROSS NEGLIGENCE AND TO THE AMOUNT OF THE FORESEEABLE (DIRECT) DAMAGE AT MOST IN CASES OF FAULT OF THE RESPONSIBLE EMPLOYEE. THIS ALSO APPLIES IN CASES OF STRICT LIABILITY.

7. Data protection

By agreeing to provide your details, you agree to your personal data being stored, processed and used by KOSTAL in compliance with the applicable data protection requirements in order to process your enquiry and for internal purposes (invitations, product information and general information). In any event, your personal data will not be disclosed to third parties without your consent, with the exception of legal obligations to furnish information.

You can withdraw your consent to this at any time by sending an e-mail to the following address: info-solar@kostal.com, in the respective newsletters or in the user settings of the PIKO Solar Portal.

KOSTAL reserves the right to make all data included in the portal anonymous and for it to be used by KOSTAL or third parties for purposes of statistical evaluation.

8. Amendment of the terms of use

KOSTAL reserves the right to amend the terms of use at any time. The user may object to amendments by deleting the account.

9. Applicable law and place of jurisdiction

In cases of dispute, all parties are required to select a place of jurisdiction in Germany. The law of the Federal Republic of Germany is agreed.

10. Final provisions

Should individual provisions of this agreement be ineffective or unenforceable or become ineffective or unenforceable following confirmation of the agreement, the effectiveness of the remaining provisions of the agreement shall remain hereby unaffected. The ineffective or unenforceable provision shall be replaced by an effective and enforceable regulation of which the effects come closest to the economic objective pursued by the parties to the agreement with the ineffective or unenforceable provision. The above provisions apply mutatis mutandis in the event that the agreement turns out to be incomplete.
